TERMS OF SERVICE

These Terms of Service (hereinafter: 'Terms') apply to all visits to and use of the website of Zavory B.V. (hereinafter: 'we', 'us' or 'the store'), as well as to all agreements concluded via our website.

By visiting our website or placing an order, you agree to these Terms. We recommend reading them carefully before making a purchase.

We reserve the right to amend these Terms at any time. The most current version is always available on our website. Amendments do not apply retroactively to agreements already concluded.

 

2.1 Product Range

Our product range is subject to change. We strive to present all product information — including descriptions, images and prices — as accurately as possible. However, we cannot guarantee that all information is entirely correct or up to date at all times.

Visible colour differences between images and the actual product may occur due to differences in screens and lighting. This does not constitute grounds for complaint or return, unless the product materially deviates from its description.

 

2.2 Formation of the Agreement

An agreement is formed at the moment that:

•        you have placed an order via our website, and

•        we have confirmed the order in writing (by email).

We reserve the right to refuse or cancel an order, for example in cases of incorrect pricing, fraud or incomplete payment.

 

2.3 Prices

All prices on our website are stated in euros (€) and include VAT, unless otherwise indicated. Shipping costs are not included in product prices and are stated separately at checkout.

We reserve the right to change prices. Price changes do not affect orders that have already been confirmed.

 

3.1 Payment Methods

We offer the following payment methods via our Shopify platform:

•        iDEAL

We reserve the right to add or remove payment methods.

 

3.2 Payment Obligation

Payment must be made prior to dispatch of your order, unless otherwise agreed. In the event of late payment, we are entitled to cancel the order and charge any collection costs incurred.

 

4.1 Dropshipping Model

Our store operates on the basis of the dropshipping model. Products are shipped directly by our (international) suppliers to the delivery address you have provided. We are responsible for the agreement with you as a consumer, even if the physical delivery takes place via a third party.

 

4.2 Delivery Times

The stated delivery times are indicative and depend on the supplier and the country of dispatch. We aim to deliver products within the indicated timeframe, but cannot provide hard guarantees for international shipments.

Indicative delivery times:

•        The Netherlands and Belgium: 5–14 business days

•        Rest of Europe: 7–21 business days

•        Outside Europe: 14–30 business days

In the event of a delay of more than 30 calendar days through no fault of our own, you have the right to dissolve the agreement free of charge.

 

4.3 Shipping Costs

Shipping costs are displayed at checkout, before completion of your order. For orders above a certain amount, free shipping may apply, as stated on our website.

 

4.4 Risk and Transfer of Ownership

The risk of loss or damage transfers to you at the moment the product is delivered to the specified address. Ownership of products transfers upon full payment.

 

As a consumer, you have the right to withdraw from the agreement within 14 calendar days of receipt, without giving any reason. The full procedure and conditions are described in our separate Return and Refund Policy, which is available on our website and applies as a supplement to these Terms.

 

We deliver products that conform to the agreement. Under Dutch law, you as a consumer are entitled to a product that meets the expectations you could reasonably have based on the description.

If a product shows defects that were not visible at delivery, we ask you to notify us as soon as possible, and at the latest within 30 days of discovery, via info@zavory.nl.

We do not offer any additional commercial warranty beyond the statutory conformity rights, unless this is expressly stated with the product.

 

7.1 Limitation of Liability

Our liability is limited to direct damages and to a maximum of the amount you paid for the relevant order. We are not liable for:

•        Indirect damage, consequential damage or loss of profit.

•        Damage resulting from improper use of the product.

•        Delays in delivery beyond our control.

•        Damage caused by force majeure (see Article 8).

 

7.2 Accuracy of Information

We strive for accurate product information, but cannot guarantee that all descriptions, specifications and images are error-free. In case of doubt, always consult our customer service before making a purchase.

 

In the event of force majeure, we are not obliged to fulfil our obligations. Force majeure includes, among other things: natural disasters, fire, pandemics, strikes, government measures, disruptions at suppliers or transport companies, and other circumstances beyond our reasonable control.

In the event of sustained force majeure lasting more than 30 days, you have the right to dissolve the agreement and will receive a full refund for undelivered products.

 

All content on our website — including texts, images, logos, graphic design, product descriptions and software — is the property of Zavory B.V. or is used with the permission of the rights holder. It is not permitted to copy, distribute or use this content without our express written consent.

 

We process your personal data in accordance with the General Data Protection Regulation (GDPR). The way in which we handle your data is described in our Privacy Policy, which is available on our website.

By placing an order, you agree to the processing of your data for the performance of the agreement and, if you have given consent, for marketing purposes.

 

You agree to use our website solely for lawful purposes. The following are prohibited:

•        Providing false or misleading information.

•        Distributing malicious software via our website.

•        Carrying out actions that disrupt the operation of the website.

•        Gaining unauthorised access to systems or data.

In the event of a violation of these provisions, we reserve the right to block your access to the website and to take legal action.

 

Our website may contain links to external websites. We are not responsible for the content, privacy policy or terms of service of these external websites. Following such links is done at your own risk.

 

13.1 Complaints Handling

Complaints about our products or services can be submitted via info@zavory.nl. We aim to handle your complaint within 14 business days. If we are unable to reach a resolution together, you may contact:

13.2 Applicable Law

These Terms and all agreements concluded via our website are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the district of our registered place of business, unless mandatory consumer law designates a different court.

 

If any provision of these Terms proves to be void or voidable, this shall not affect the validity of the remaining provisions. The void provision shall be replaced by a valid provision that corresponds as closely as possible to the intention of the original provision.

We are entitled to transfer our rights and obligations under these Terms to a third party, provided this has no adverse consequences for you as a consumer.
